The Cinetorium Code

Our Code of Conduct

1. General Terms and Conditions 

1. Cast, Crew & Venue Staff

  1.  Compulsory Activity  
    All members are required to attend workshops, productions, events, and public/media appearances when required. Frequent failure to do so without notice may need to result in dismissal from Branch.
     

  2. Zero Bullying or Abuse Tolerance. 
    As we take the safety and well-being of our members very seriously, Cinetorium will not tolerate any form of bullying, grooming, violent or aggressive behaviour of any kind towards any of our Artists, Film/Stage Cast or Crew, Patrons or members of staff. Any breach of this clause may lead to dismissal from Branch.  
     

  3. Social Drugs, Alcohol, or Smoking Strictly Prohibited. 
    For the safety of our young members, Cinetorium does not allow any use of social or illegal drugs, use of alcohol, or smoking or vaping of any kind.​
     

    1. Branch Authorities reserve the right to ask anyone under the influence of drugs or alcohol to leave the premises immediately.
      ​

      1. Clause may be excused if...
         

      2. The member requires medication for medical reasons. ​
         

      3. The member excuses him/herself for a smoking break.
         

      4. Smoking or Vaping takes place within 10 metres from the ground.
        ​

  4. Cinetorium Offers a Diverse Environment
    Cinetorium welcomes ALL people into the United Family, regardless of age, gender, race, orientation, disability, or religion. Some productions or roles, however, may be limited with age requirements. 
     

  5.  Please Respect Our Religion  
    Cinetorium's religion originates from the Christian faith, with various principles and values which differ from a traditional Christian or Catholic Church. While Cinetorium will respect your own religious beliefs, we ask that you do the same for ours. 'Bible Bashing' or any offensive atheist comments will not be tolerated. 
     

  6. Contact Guidelines​
    While Cinetorium encourages hugs, cuddles and gestures of affection towards our members, all affectionate or physical contact must be done under mutual agreement and the respect of each member's comfort level. Romantic or intimate gestures of any kind between adults and minors are strictly prohibited and may result in dismissal. Police may also be notified if felt necessary

2. Patrons or Audience 

  1.  No Ticket - No Entry 
    It is a requirement for ALL patrons to hold a ticket to enter the theatre. 
     

  2. One Ticket Per Seat
    Each ticket can only reserve one seat per session.
     

  3. Ticket Requirements.  
     

    1.  Adult Ticket - Ages 15 + up.
       

    2.  Child Ticket - Ages 15 + under
       

    3. Student Ticket - Must Hold Student ID.​
       

  4.  No Flash Photography 
    Cinetorium does not permit flash photography in the theatre under any circumstances 
     

  5. Media Pass Required to Film in Theatre
    A Media Pass Holder reserves the right to film the live segments of the show ONLY - any filming of the projected cinematic storytelling elements, however, is STRICTLY prohibited. Video footage collected in the theatre may be used for social media video content, film documentation, stock footage, or news material, under the condition that the footage is used respectfully and provides no 'backlash' to Cinetorium or any of its members, or promotes any bad publicity whatsoever. Encouragement of supporting Cinetorium through buying of tickets, merchandise, or tipping our members via our website should also be brought up in social media material (News Material optional). 'Special Thanks to Cinetorium Youth Entertainment & Social Group’ must also be given by mouth, or during the video credits.

  7. Cinetorium reserves the right to request the removal of footage or film/news report release should any of the conditions be breached. 
     

  8. Cinetorium Staff reserved the right to remove any patron or member of the public who maybe... 
     

    1. Mistreating another patron or showing volient or agressive behaviour.
       

    2.  â€‹Are suspected of under the influence of drugs or alcohol 
       

    3.  May be causing a public disturbance in any way. 
       

    4. Is violating any of the Clauses 1.2.1. to 1.2.5

2. Child Safety Policies 

  1. We Take Child Safety Seriously
    Cinetorium's mission is to provide a safe and sacred environment for youth to grow as artists. Therefore, we take child safety very seriously. Any breach of the Child Safety Act 1999 may and will be reported to the correct authorities. Police may also be notified if necessary. 
     

  2. Minors to have Adult Supervision at ALL times. 
    Whether by an appointed 'Youth Angel', 'Manager', Parent or Guardian, ALL Minors (persons under 18) MUST be supervised by an appointed caring adult at all times. This clause especially comes into effect when a minor is making a media or public appearance. Minor should be in Adult's view at all times, and Adult should step in to protect and support minor when in need. 
     

  3. Zero Child Abuse Tolerance
    Any grooming, exploiting, violent, or aggressive behaviour towards a minor will not be tolerated and may result in dismissal. Police may also be notified if necessary. 
     

  4. Adults are not to be left alone with Minor. 
    It is strict Cinetorium Policy that an adult shall never be left alone with a minor. A minimum of two adults are to be with 1 or more minors at a time, unless the adult is the minor's parent or guardian. 
     

  5. Working Hours
     

    1. Ages 12 to 15: Can not work no more than 4 hours a day and 8 hours a week. Can not work after no later than 8:00pm on a school night, and no later than 9:00pm on an off school night. 
       

    2. Ages 16 to 18: The same hours specified in Cause 2.4.1 apply if the member is still in school. If not still in school however, member may work past 9:00pm, and up to 10 hours a day. 
       

    3. All members regardless of age are entitled to a break of 2 hours of work. 
       

  6. Cinetorium Can Not Be Responsible For Students Cutting School. ​
    No school student can be expected to work for a Cinetorium workshop, production, event, or even a social gathering on a school day. No student can use Cinetorium activities as an excuse to cut school. All Production/Event Dates MUST take place on weekends or school holidays - providing the school students with some form of holiday from both school and Cinetorium work.

  7. Blue Card Required. ​
    For the sake of working legally with children and young people, ALL Artists and Mentors are required to hold an active 'P' Blue Card. 
     

  8. Proof of Parental Consent Required of ALL Activities.
    Members under 18 must supply a signed parental permission slip with every activity associated with Cinetorium, including; workshops, productions, events, and social gatherings. â€‹â€‹

3. Content Guidelines 

  1. We Accept Unsolicited Material From Members Only 
    Cinetorium accepts unsolicited material from Category A Sub-Contractors only.
     

  2. Acceptable Content â€‹â€‹â€‹â€‹â€‹
    ​We may accept material with the following... 
     

    1. Stories and Characters taken from the Universal Arc (with consent from the organisation's authorities)
       

    2. Original stories of Artists' own creation
       

    3. Minor Fantasy, Action, or Slap-Stick related violence
       

    4. Low level themes referencing a hint of child abuse, homophobia, bullying, mental illness or issues, which play an important part to the story (As long as the actor isn't physically or emotionally harmed in anyway)   
       

    5. Mild nudity - ie exposed in underwear, bath or shower, wrapped in towel, or exposing male torso. (genitals, buttocks, or bare female breasts however can not be shown by any actor of any age). 
       

    6. Mild Intimate behaviour (ie skin content, kissing, hugging and making out - however, these scenes can â€‹NOT be performed by actors under 16.) 
       

    7. Mild Course Language - used for humour and expression of sudden shock. 

       

  3. Content Restrictions:
    We can not accept material featuring the following. ​

     

    1. Restricted Material including but not limited to... 
       

      1. Graphic Voilence (ie Blood and Gore) ​
         

      2. ​High Level Course Language (some language can be accepted to a degree) 
         

      3. Full Nudity 
         

      4. Pornography or sexual content of any kind
         

      5. Drug Use or References of any kind ​
         

    2.  Scenes showing a child or young adult getting brutally beaten or harmed in anyway. 
       

    3. Language that may encourage homophobia, child abuse, course atheist language or behaviour, references to purposely mock religion or racial cultures of any kind. 
       

    4. Material which promotes our artists as a sex symbol, or idol in anyway.
       

    5. Any content of any kind that may develop controversy or bad reputation  Cinetorium as an organisation in any way.  
       

    6. Content which may feature content protected by the Copyright Act 1968. 
       

4. Copyright & Intellectual Property 

Copyright is a legal right of the official creator of Intellectual Property to request permission to copy their work for publication, release, sale, promotion or exhibition. In some cases, a special license will be require to copy or present works, in other cases, a simple written agreement will be enough. 

Intellectual Property (IP) are the works of an artist or organisation, these works can be, film, music, books, characters, stories, songs or simple works of art. By Australian Law, once artist has record, written, or drawn a their own original creational work, the copyrights of their piece immediately goes to them, or the organisation who has rights to the original artist's work. 

  1. The Universal Arc 
    Cinetorium reserves the copyrights to the Universal Arc book series, as well as its adapted songs, films, and characters. Any use of intellectual property related to Cinetorium's Universal Arc requires special permission granted in a signed written agreement by Jason Wingate (or his estate after death) - Owner of Cinetorium Youth Entertainment & Social Group. Cinetorium reserves the legal right to prosecute if any intellectual property related to Cinetorium's Universal Arc is copied without written consent. 
     

  2. Original Work from Category A Sub-Contractor  
    Category A Sub-Contractors reserve ALL copyrights to their own original work under a signed written agreement with Cinetorium. Any use of Category A Sub-Contractor's intellectual property requires special permission granted in a signed written agreement by the Category A Sub-Contractor (or his/her estate after death). Category A Sub-Contractor (or his/her estate after death) reserves the legal right to prosecute if any intellectual property is copied without written consent. Cinetorium, however, reserves the right to copy, re-use, distribute, and even promote Category A Sub-Contractor's work with no further consent or payment required. This clause survives even after Category A Sub-Contractor's written agreement expires. 
     

  3. Peter Pan (Child of the Light)
    Peter Pan, Wendy, John, Michael, Captain Hook, Smee, Tinker Bell, and Tiger Lily are the intellectual property of JM Berries - author of 'Peter Pan and Wendy' (1911). As the original book and play written by JM Berries are currently in the public domain, Cinetorium reverses the right to use the characters as they see fit. However, the Cinetorium adaptation of these characters is by law protected under the intellectual property of Cinetorium’s Universal Arc, as specified in Clause 4.1.
     

  4. Jesus Christ (Lord of the Light)
    In Australia, the historical/religious figures or persons like Jesus Christ cannot legally be copyrighted. However, the writings of the Universal Arc, and adapted films, music, or merchandise containing Jesus Christ as 'The Lord of Light' are protected under Cinetorium's Universal Arc intellectual property as specified in Clause 4.1.   
     

  5. Copyrights outside of Cinetorium
    Cinetorium cannot be responsible for copyright violations, and will not accept any film or music content containing third-party images, cut-in footage, music tracks/soundtracks - or any other unauthorised copyright-protected content. This clause, however, can be avoided if the content holder holds a licence or written agreement for the use of third-party content. 

5. Uniforms & Costumes

  1. All Members of the United Family are required to wear the Cinetorium Uniform to all workshops, productions, events, and social activities. Unless the member is performing or in character.

      3. Vest with Logo (Or Hoodie Jacket if desired - with Logo 
         

      4. Cap with Logo (If Desired) 
         

    3. Backstage Production Crew (For events only) 
       

      1. Black Cotton T-Shirt - With Logo on front and 'Production Crew' on back​
         

      2. Black Trousers/Shorts 
        ​

  2. ​Actors are to stay in character from the time the costume goes off to the time the costume goes off. If the actor needs a break for any reason, including needing the restroom facilities, the actor must notify the supervisor to have them discreetly removed and escorted to the appropriate facilities. 
     

  3. Cinetorium is responsible for supplying uniform and costume materials. Cast reserve the right to request reimbursement for costume or prop items purchased exclusively for a production or an event. However, receipt must be supplied. 
     

  4. Once received, all United Family Members are responsible for their own uniform items, and are responsible for replacing them... see our online uniform store for details.  
     

6. Dismissals, Leave, and Resignation 

  1. Cinetorium Management reserves the right to dismiss or terminate the contract of any member who consistently violates any of the clauses specified in this Code of Conduct. No other member apart from Cinetorium Management however reserves the right to dismiss a member from his/her position. 
     

  2. All Members reserve the right to a long-term break or resign from their position with Cinetorium anytime - unless they are in the middle of a production or event session. 
     

  3. Any Member wanting to take a break or resign from Cinetorium, or any managing role wanting to dismiss a member for their position with Cinetorium, must WAIT until the member has completed a production or event season. 

7. Talent/Crew Release 

  1. By signing any of our contracts between Categories A to E, Sub-Contractors grant the label permission to film or record them anytime during a workshop, production, event, or social activity. 
     

  2. Cinetorium reserves the right to use video footage or recorded audio of members’ images or voices for film/video, audio/music tracks, television, radio, social media, promotional print (including but not limited to posters, digital artwork, and flyers/brochures), book publication, and merchandise (including but not limited to t-shirts, caps, drink bottles, key rings, magnets, pens, games, and toys). And can be used to copy, edit, distribute, exhibit and sell.    
     

  3. While crew members may be featured in ‘Behind-the-Scenes’ material, and may appear at public or media appearances, they shall NOT be included in promotive print or merchandise. 

8. Compensation

  1. All signed sub-contractors are reserved for payment under a referred commission agreement. However, Cinetorium cannot grant any request for a raise or fixed rate at this time. Please see Commission Guidelines for further details. 
     

  2. Cinetorium can not, and will not offer any travel compensation at this time.    
     

  3. Cinetorium can not provide sick leave, parental leave, or holiday leave at this time. 
     

  4. Cinetorium can offer reimbursements for costume and prop materials purchased exclusively for productions. Receipt, however, must be supplied. 
     

  5. Cinetorium's liability unfortunately does not cover accidents or injuries sustained by our subcontractors. Organising your own personal cover for work is highly recommended. 
     

  6. Cinetorium is a non-union organisation; therefore, ALL sub-contractors will be entering into a legal agreement at their own risk.
